The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on February 19, 2020 at 10:00 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra, David Assman, Howard Heinert and Marshal Tinant. Also present was Auditor Barbara DeSersa and Chad Chauncey.
Tinant made the motion, seconded by Valandra, to approve the agenda as written.
Roll call: All ayes. Motion carried.
Tinant made the motion, seconded by Assman, that the minutes of the meeting held on February 5, 2020 be approved as read.
Roll call: All ayes. Motion carried.
No conflict of interest reported.
Chad Chauncey appeared for Public Comment. Mr. Chauncey came to the meeting with a list of questions for the Commissioners. He asked why all county employees were not drug tested. The commissioners informed him that they were. Mr. Chauncey asked why the Highway employees are at the shop at 6:00 a.m. and they don’t leave until 8:00 a.m. He suggested the Highway employees could drive through the streets during that time and let Barry know if they see anything suspicious. Mr. Chauncey also asked why Mr. Storms drives the County vehicle seven days a week when he isn’t working. Another question was about the culvert they replaced North of Mission. Mr. Chauncy said it is 2 ft. above the water level and water is running under it. Mr. Chauncey asked if every employee is drug tested including Alvin Pahlke, States Attorney. The Commissioners explained Mr. Pahlke is contracted and he’s not an employee. Mr. Chauncey would also like to see Mr. Pahlke’s bill to the County, itemized in the minutes. The Commissioners indicated that it is not their practice to disseminate the details of any county bills and that the total amount to be paid was sufficient, as with all other claims. Mr. Chauncey requested a police report to be listed in the newspaper and he thinks they should be advertising for a Deputy Sheriff to work with the Sheriff as there is a need for more patrolling.
Barry Bailey, Acting Sheriff, entered the meeting. Mr. Bailey said they don’t currently have any City Police Deputies as it is extremely difficult to find qualified applicants, and that when an applicant is found, they often leave the City to work for the Tribe, as the Tribe pays higher wages. Mr. Bailey said it is a requirement for an applicant to have shooter training before being hired.
Mr. Chauncey asked why the Sheriff and States Attorney aren’t elected in Todd County. The Commissioners explained that Todd County is a home rule county. He then asked when the States Attorney’s contract expires and why do they use the Tripp County States Attorney. The last question was, what do the Commissioners plan to do about the law enforcement situation in Todd County. He thinks they should be advertising for 2 part-time Deputies.
Toby Qualm, Department of Legislative Audit, came to the meeting to inform the Commissioners he is in the process of auditing the years 2017-2018 for Todd County. Mr. Qualm is performing the audit and gave a letter to the Commissioners to sign, if the letter correctly expressed the process. Heinert made the motion, seconded by Valandra, to give the Chairman permission to sign the letter of understanding from the Department of Legislative Audit.

Hugh Storms, Highway Superintendent, came to the meeting to give his report. The crew bladed Road 125, Paulson road and Elk Valley road. The new wing for the blade is in and they are in the process of putting it on the blade. The Commissioner asked about the culvert Mr. Chauncey mentioned previously. Hugh indicated that it had been dug out and properly installed, and that there shouldn’t be water running under it, but he would check it out. The Commissioners also asked what time the employees get to the shop, when do they leave and what do they do at the shop until then. Mr. Storms said they get there at 7:00 and get the trucks started, go over the day’s work schedule and leave between 8:30 and 9. They are unable to start blading until afternoon when it starts to thaw. Mr. Tinant asked if the employees can adjust their schedule so that they are working when conditions are good and not clocked in when there is no work to be done. Mr. Storms indicated that when possible, such as during storms, work schedules are adjusted this way but for the most part the employees have home and family lives that require that they have a set work schedule.
Assman made the motion, seconded by Tinant, to adopt the following:
RESOLUTION (11-2020):
Be it Resolved by the Todd County Board of Commissioners to increase Brad Beck’s and Randy Vrbka’s wage to $15.60 per hour effective February 23, 2020 and bypass the 90-day probation, due to previous experience.

At 10:50 a.m. Tinant made the motion, seconded by Heinert, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

At 11:10 a.m. Tinant made the motion, seconded by Assman, to return to regular session.

Tinant made the motion, seconded by Assman, to give the Auditor permission to advertise for gravel crushing and processing to be opened March 18, 2020 at 10:30 a.m.

The State has changed the reimbursement rates for meals. Tinant made the motion, seconded by Valandra to approve the following meal reimbursement:
1. When employees travel, meals shall be reimbursed at a per diem, per meal, the following amounts:
a. Breakfast: $6.00 when leaving before 5:31 a.m., returning after 7:59 a.m.
b. Lunch: $14.00 when leaving before 11:31 a.m., returning after 12:59 p.m.
c. Dinner: $20.00 when leaving before 5:31 p.m., returning after 7:59 p.m.
d. Up to a maximum of $40.00 per day.

Ron Valandra, VSO, had asked at the last meeting about the vacation time he would have accrued last year when he was full time. Heinert made the motion, seconded by Tinant, to give Ron Valandra, VSO, 30 hours of vacation that was accumulated in 2019.
