January 8, 2020

The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on January 8, 2020 at 10:00 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra, David Assman, Howard Heinert and Marshal Tinant. Also present was Auditor Barbara DeSersa.

No conflict of interest reported.

No one appeared for Public Comment.

Tinant made the motion, seconded by Assman, that the minutes of the meeting held on December 27, 2019 be approved as read.

Roll call: All ayes. Motion carried.

Nominations were opened for Chairman for 2020. Tinant nominated Gregg Grimshaw for Chairman. Tinant made the motion, seconded by Assman, that nominations cease and a unanimous ballot be cast for Grimshaw for Chairman.

Roll call: All ayes. Motion carried.

Nominations were opened for Vice-Chairman. Assman nominated Marshal Tinant for Vice-Chairman. Assman made the motion, seconded by Valandra, that nominations cease and a unanimous ballot be cast for Tinant as Vice-Chairman.

Roll call: All ayes. Motion carried.

Assman made the motion, seconded by Tinant, to adopt the following:

RESOLUTION (1-2020):

Be It Resolved by the Todd County Board of Commissioners that each member of the Board of Commissioners shall be compensated at the rate of $400.00 per regular meeting attended, and

Further Be It Resolved that each Board member shall be compensated at the rate of $100.00 per special meeting attended, and Be It Resolved Further each Commissioner shall receive mileage at state rate for each mile traveled to attend Board meetings.

Valandra made the motion, seconded by Heinert, to appoint Dianna Assman to the Fairboard as her term had expired.

Heinert made the motion, seconded by Valandra, to appoint the Weed and Pest Board members as follows:

Valandra made the motion, seconded by Assman, to adopt the following:

RESOLUTION (2-2020):

Be It Resolved by the Todd County Board of Commissioners that the Superintendents, Deputies and Interpreters of each election shall be paid a fee of $200.00 pursuant to SDCL 12-15-11 and

Further Be it Resolved, the person delivering the supplies and ballot boxes to the Sheriff’s office or Auditor’s Office shall receive state rates per each mile necessarily traveled in going to and returning from making the delivery, and

Be It Resolved Further that all Superintendents, Deputies and Interpreters shall be allowed a fee of $50.00 for attending an election school at a time and place fixed by the County Auditor.

Valandra made the motion, seconded by Tinant, to adopt the following: 

RESOLUTION (3-2020):

Be It Resolved by the Todd County Board of Commissioners to hereby appoint Monica Rahn as Coroner for Todd County, and 

Further Be It Resolved Ms. Rahn shall be compensated at the rate of $100.00 per call and receive mileage at state rate for miles traveled to fulfill her duties.

Valandra made the motion, seconded by Heinert, to adopt the following:

RESOLUTION (4-2020):

Be It Resolved by the Todd County Board of Commissioners to hereby compensate members of the Fairboard $25.00 per meeting attended, and

Further Be It Resolved that each member of said Board shall be compensated for miles driven to fulfill that duty at the state rate for mileage.

RESOLUTION (5-2020):

Be It Resolved by the Todd County Board of Commissioners to hereby designate the Todd County Tribune as the official newspaper for Todd County for 2020.

Assman made the motion, seconded by Heinert, to adopt the following:

RESOLUTION (6-2020):

Be It Resolved by the Todd County Board of Commissioners to hereby designate Wells Fargo Bank in Mission and First Fidelity Bank and Bank West, both located in Winner, South Dakota, as official depositories of county funds.

Valandra made the motion, seconded by Assman, to adopt the following:

RESOLUTION (7-2020):

Be It Resolved by the Todd County Board of Commissioners that the Board of Commissioners shall meet for the transaction of official business on the first and third Wednesday of each month unless rescheduled, with the exception of September, when the first meeting of the month shall be held on the first Tuesday for consideration of the provisional budget pursuant to SDCL 7-21-8.

Special Agent Robert Sedlmajer, RST Major Crimes Investigator, Captain Iver Crow Eagle, RST Police Dept. and Wesley Sudbeck, Deputy Sheriff came to the meeting to discuss jurisdictional issues, and how we can combat crime in Todd County with solid communication and relationships between officers of the Rosebud Sioux Tribe, Todd County and Mission City. Mr. Sedlmajer advised that per his job title, a major crime is one punishable, by law, with incarceration of more than one year. His office is inundated with crimes of an urgent nature such as sexual assault, homicide, and major drug violations. For this reason, crimes of lesser urgency such as burglaries with complicated jurisdictional intricacies and little hope for resolution due to the nature of the crime, receive lower priority treatment. With cooperation between all law enforcement agencies in the area, it could be possible to solve and prosecute more of these types of crimes. All parties present agreed that we would like to do all that is possible to support local law enforcement in working together to reach mutual goals. 

Hugh Storms, Highway Supervisor, came to the meeting to give his report. A grader is broken down so 4 blades were out moving snow after the last storm. Work began on Tuesday, January 31 when the wind finally stopped, and continued New Year’s Day. All roads except one were opened by Friday, January 3rd. As the graders are in Mission at the county yard, they start with the closest roads and work their way outward in the county. After opening all the roads so everyone can get out, they then go back and widen them. That process had begun at the time of the meeting.

Monica Rahn came to the meeting to discuss the position for Administrative Assistant.

Wesley Sudbeck, Deputy Sheriff, came to the meeting to ask questions about his position as Sheriff after he completes his 90-day probation period, as dictated by the policy manual. The Commissioners indicated that they would evaluate his pay at the end of that period, and again when he has completed the Police Academy Training in Pierre and becomes a State Certified Officer. Discussion was held about on-call pay.

The Register of Deed’s Statement of Fees Collected during the Month of December, 2019 showed $2,063.00.
