November 20, 2019

The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on November 20, 2019 at 10:00 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra, David Assman and Howard Heinert. Absent was Marshal Tinant. Also present was Deputy Auditor Terri Fisher, Chad Chauncey, property owner, Fred Skaggs, property owner and Sonja Lurz, Highway Secretary.

Sonja Lurz, Highway Secretary, asked the commissioners for permission to have Walt Lurz, Todd County resident, ride along with Wesley Sudbeck, Deputy Sheriff, and show him around the County. 

The Commissioners agreed to have Mr. Lurz show Wesley Sudbeck, Deputy Sheriff, around the County.

At 10:05 a.m. Amy Whiting, tax payer, joined the meeting during public comment to discuss a potential mistake on her property taxes. Mrs. Whiting left the meeting.

Alvin Pahlke, State’s Attorney, joined the meeting to discuss jurisdiction within Todd County. Discussion was held on past crimes that have occurred in the County and how they were handled. 

Mr. Assman inquired about Todd County working with Mellette County’s Sheriff’s Department. Discussion was held. Mr. Pahlke left the meeting. 

Fred Skaggs, property owner, asked the Commissioners if they would be willing to invite a representative from the Rosebud Sioux Tribe to the next meeting to discuss past crimes and jurisdiction issues. Mr. Grimshaw offered to ask them. 

Hugh Storms, Highway Superintendent, joined the meeting. Chad Chauncey, property owner, inquired about having a culvert installed on a road north of Mission. Mr. Storms confirmed that he would be able to install it. Mr. Chauncey left the meeting. Discussion was held on County Rd. 125. Mr. Storms informed the Commissioners that the motor grader that is broken down is unable to be fixed. Also, the 2014 motor grader is close to reaching its warranty. Valandra made the motion, seconded by Assman, to purchase an extended warranty for an additional 1,000 hours for the 2014 motor grader. 

Roll call: All present ayes. Motion carried. 

Discussion was held on employee health insurance. 

Janiece Weber, Director of Equalization, joined the meeting to give an Ag Task Force presentation to the Commissioners. Mrs. Weber has sent out owner occupied letters and discussed building permits.

Doug Dillon, tax payer, joined the meeting to discuss delinquent taxes. 

Kevin Busch, landowner, joined the meeting to present a plat for the approval of the Board.

Valandra made the motion, seconded by Heinert, to adopt the following: 

RESOLUTION (27-2019):

WHEREAS: the owner of the land herein platted as Lot 1 BUSCH FIRST SUBDIVISION, located in the South ½ of the East ½ of the SE ¼ of Section 1, T38N, R29W of the 6th P.M., Todd County, SD, have presented to the Todd County Board of Commissioners the described plat for their consideration and approval, and it appears that the plat conforms to all requirements of SDCL 11-3-8, NOW THEREFORE, BE IT RESOLVED that the County Commission, in and for Todd County, does hereby approve the said plat of Busch’s first subdivision.

Alvin Pahlke, State’s Attorney and Wesley Sudbeck, Deputy Sheriff joined the meeting. Marshal Tinant also joined the meeting via speakerphone.

At 11:40 a.m. Assman made the motion, seconded by Heinert, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

Roll call: All present ayes. Motion carried.

At 11:55 a.m. Assman made the motion, seconded by Heinert, to return to regular session.

Roll call: All present ayes. Motion carried.

Mr. Pahlke and Mr. Sudbeck left the meeting.

At 11:56 a.m. Heinert made the motion, seconded by Assman, to enter into Executive session to discuss a personnel issue, Highway Secretary interview, pursuant to SDCL 1-25-2 (1).

Roll call: All present ayes. Motion carried.

At 12:00 p.m. Assman made the motion, seconded by Heinert, to return to regular session.

At 12:01 p.m. Lavern Lanz, Todd County resident, joined the meeting to discuss 9-1-1 addresses. Mr. Lanz is concerned because EMT’s have trouble finding residences in Todd County. Mr. Lanz would like the Commissioners to research the process of installing 9-1-1 address signage in the County. The Commissioners will check into the signage.

Valandra made the motion, seconded by Heinert, to add Clyde Clairmont and Eric Emery to the LEPC Committee.

The Register of Deed’s Statement of Fees Collected during the Month of October, 2019 showed $638.50.

Assman made the motion, seconded by Valandra, to change the last meeting in December to the 27th to pay the end of year bills.

Roll call: All present ayes. Motion carried.

Valandra made the motion, seconded by Heinert, that the minutes of the meeting held on November 5, 2019 be approved as read.
