November 5, 2019

The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on November 5, 2019 at 10:00 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra, David Assman, Howard Heinert and Marshal Tinant. Also present was Deputy Auditor Terri Fisher, Chad Chauncey, property owner, Fred Skaggs, property owner and Barry Bailey, Acting Sheriff.

Chad Chauncey, property owner and Fred Skaggs, property owner, both wanted to express their dissatisfaction in the quality of work done by both the Todd County Sheriff and Todd County State’s Attorney. Both land owners have been victims of burglaries. Barry Bailey, Acting Sheriff, informed all that he has followed appropriate procedures regarding these events. Discussion was held. 

Mr. Chauncey and Mr. Skaggs left the meeting.

Barry Bailey, Acting Sheriff, stayed in the meeting for Sheriff interviews. 

At 10:20 a.m. Tinant made the motion, seconded by Assman, to enter into Executive session to discuss a personnel issue, Sheriff interviews, pursuant to SDCL 1-25-2 (1).

Roll call: All ayes. Motion carried.

At 11:03 A.M. Tinant made the motion, seconded by Assman, to return to regular session.

Mr. Bailey presented a surplus firearm list to the commissioners to ask permission to sell them at an auction. Assman made the motion, seconded by Heinert, to adopt the following:

RESOLUTION (25-2019):

Be it Resolved by the Todd County Board of Commissioners to hereby declare the following personal property (Sheriff) as surplus property for sale or disposal:

Roll call: Ayes: Grimshaw, Valandra, Assman, Heinert and Tinant. Nays: None. Resolution adopted.

Hugh Storms, Highway Superintendent, and Wade Iszler, RDO, joined the meeting. Mr. Storms said the grader that was sent to RDO for repair will cost more than the grader is worth post-repair. Mr. Iszler gave a presentation to the Commissioners about purchasing a new motor grader vs. leasing a new motor grader. Todd County can order a new motor grader now and decide whether to purchase or lease it later. Further discussion was held. Tinant made the motion, seconded by Valandra to give Mr. Iszler permission to order a new motor grader and permission for Mr. Grimshaw to sign the contract agreement with RDO. 

Roll call: All ayes. Motion carried.

Mr. Iszler left the meeting. Mr. Storms gave his report. Discussion was held on roads that still have standing water on them. The Commissioners inquired about the progress on County Road 125. Mr. Storms informed the Commissioners that his crew has pulled shoulders and graveled this road. 

Assman made the motion, seconded by Heinert, to give Hugh Storms and Gregg Grimshaw permission to sign the Golden West Telecommunications utility permit applications.

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Heinert, to approve the 2020 Application for the Alcoholic Beverage License Application submitted by the Rosebud Sioux Tribe/ dba Rosebud Casino for Retail (on-sale) Liquor with Sunday sales.

Roll call: Ayes: Grimshaw, Assman, Heinert and Tinant. Nays: Valandra. Motion carried.

The Auditor’s Account with the Treasurer was presented for the approval of the Board as follows:

Assman made the motion, seconded by Tinant, to adopt the following:

RESOLUTION (26-2019):

Be it Resolved by the Todd County Board of Commissioners to herby hire Wesley Sudbeck as full-time, Deputy Sheriff effective November 19, 2019 and be compensated at the rate of $16.50 per hour with a 90-day probation.
