March 20, 2019

The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on March 20, 2019 at 10:04 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra, Howard Heinert and Marshal Tinant. Also present was Auditor Barbara DeSersa and Dave Arnold, Flat Creek Construction.

Anthony Red Bear, Deputy Sheriff, entered the meeting.

At 10:11 a.m. Tinant made the motion, seconded by Heinert, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

Roll call: All ayes. Motion carried.

Dave Arnold, Flat Creek Construction, left during executive session.

At 10:14 a.m. Tinant made the motion, seconded by Valandra, to return to regular session.

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Valandra, that employment be terminated for a Highway employee that neglected to follow the Todd County Drug and Alcohol Policy. 

Roll call: Ayes: Grimshaw, Valandra and Tinant. Nays: Heinert. Motion carried.

Andrew Red Bear, Deputy Sheriff, brought estimates ian and gave his report on ongoing investigations. He also provided an estimate to repair damage to the Sheriff Department’s vehicle. Commissioner Tinant suggested that more than one estimate be gotten. Mr. Red Bear indicated that he would get an additional estimate or estimates. 

Lucy Peterson came to the meeting to ask the Commissioners about purchasing a lot her parents once owned, but it is in the Counties name. The Commissioners will check on the procedure and get back to her.

At 10:30 a.m. the bid opening for gravel crushing for 2019-2020 was held as advertised. Mr. Arnold and Hugh Storms, Highway Superintendent was present for the bid opening. Bids were received as follows:

1. Flat Creek Construction, LLC, Valentine, NE 

Whipple Pit $2.00/ ton Pit Run w/o royalty

Whipple Pit $4.49/ton 1 3/8-inch screened

Paulson Pit $3.49/ton w/o royalty 

Tinant made the motion, seconded by Heinert, to accept the bid from Flat Creek Construction, LLC. as presented.

Roll call: All ayes. Motion carried.

Hugh Storms, Highway Superintendent, gave his report. The crew has been busy opening roads from the recent snow storm. There is one road left to open that doesn’t have an alternate route out and there are other roads will be widened and opened soon. Many roads need gravel, but they are not able to get to the gravel pit. Many roads are under water as well. Discussion was held on disaster resolution. Tinant made the motion, seconded by Valandra to adopt the following:

RESOLUTION (12-2019):

WHEREAS, during the late Winter and early Spring of 2019, Todd County has received substantially more than normal precipitation;

WHEREAS, the increase of snowfall and ensuing wet conditions have caused extensive damage to County roads;

WHEREAS Todd County, is in need of assistance in coping with the hardships resulting from the flooding; and

NOW THEREFORE BE IT RESOLVED by the Todd County Board of Commissioners as follows:

1. Todd County is hereby declared to be in a state of disaster and emergency arising from the flooding.

2. The Board of County Commissioners request that Todd County be designated as a disaster area and eligible for emergency and disaster assistance, by the Governor of the State of South Dakota and other appropriate authorities of the State of South Dakota and of the United States Government and that its residents be afforded an opportunity to participate in State and Federal disaster relief programs and benefits.

3. That the Todd County Auditor is authorized and directed to communicate this declaration to the appropriate State and Federal authorities.

Valandra made the motion, seconded by Tinant, to give the Auditor permission to advertise the Director of Equalization meeting to be held April 17, 2019 at 10:10 a.m. 

Roll call: All ayes. Motion carried.

Heinert made the motion, seconded by Valandra, that the minutes of the meeting held on March 6, 2019 be approved as read.

Roll call: All ayes. Motion carried.

Discussion was held on the price of Rent Todd County receives from the US Judicial System. The current monthly price is $450.00. Tinant made the motion, seconded by Heinert, to renew the contract for the same monthly price of $450.00.

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Heinert, to terminate a Highway employee, due to unexcused leave.

Roll call: All ayes. Motion carried.

Valandra made the motion, seconded by Heinert, that the claims be approved as follows:

A 11:35 a.m. Heinert made the motion to adjourn until April 3, 2019 at 10:00 a.m., seconded by Valandra.
