The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on December 28, 2018 at 10:12 a.m. Roll call showed Board members Gregg Grimshaw, William Giroux and Marshal Tinant. Absent was Patsy Valandra. Also present was Auditor Barbara DeSersa and Howard Heinert.

Larry Jones came to the meeting to present a plat for the approval of the Board.

Tinant made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (26-2018):

A RESOLUTION APPROVING THE PLAT OF PEACE EVANGELICAL TRACT 1, a Tract of Land Located in Part of the SW1/4 of Section 9, T38N, R28W of the 6th P.M., Todd County, South Dakota.

Whereas, the plat of the above described property has been executed according to the stature, now therefore

Be it Resolved that the County Commissioner, in and for Todd County, does hereby approve the said plat of Peace Evangelical Tract 1.

At 10:25 a.m. Patsy Valandra entered the meeting.

Howard Heinert expressed interest in filling the vacant position of District IV Commissioner.

At 10:31 a.m. Tinant made the motion, seconded by Giroux, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

Roll call: All ayes. Motion carried.

At 10:33 a.m. Tinant made the motion, seconded by Giroux, to return to regular session.

Tinant made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (27-2018):

Be it Resolved by the Todd County Board of Commissioners to hereby appoint Howard Heinert to finish the term of District IV Commissioner.

Tinant made the motion, seconded by Valandra, that the minutes of the meeting held on December 5, 2018 be approved as read.

Roll call: All ayes. Motion carried.

Hugh Storms, Highway Superintendent, came to the meeting to give his report. Discussion was held on a grader that is broke down and the amount of money they would need to put into it, is more than it’s worth. Mr. Storms said they could finance a new grader through John Deere for $323,969.04. The Commissioners decided to wait with the purchase. The crews were out plowing snow. Mr. Storms left the meeting.

Mr. Tinant informed the board he had contacted Brosz Engineering, Inc. about the 5-Year plan for the Todd County highway department. Brosz Engineering indicated that they would assist in writing the five-year plan which would address all proposed road and bridge projects and routine maintenance of the existing roads. The 2018 deadline for submitting the plan has passed. Mr. Tinant will work with Brosz to create the plan beginning in March. The five-year plan is required to make the county eligible for BIG (bridge improvement grant) monies, which will be needed for a bridge repair in the near future. 

Barbara DeSersa, County Auditor, was present for the public hearing for various supplements to the 2018 budget. Tinant made the motion, seconded by Valandra to adopt the following:

RESOLUTION (28-2018):

WHEREAS it is necessary to supplement the 2018 Annual Budget in order to carry on the indispensable functions of Todd County; and 

WHEREAS, the adoption of the proposed Supplemental Budgets was duly considered by the Todd County Commission on the 5th day of December 2018, at 11:00 a.m., in the Commission Meeting Room, pursuant to due notice; now, therefore, be it

RESOLVED by the Todd County Commission that the following Supplemental Budgets be, and the same is, hereby approved for the purpose of providing budget to conduct the indispensable functions of Government, to-wit:

Tinant made the motion, seconded by Valandra, to transfer funds from the Contingency budget to the following 2018 budgets:

141- Auditor $19,186.00

153- CAA $12,806.00

212- Jail $3,483.00

441- Mental Handicap-Yankton $525.00

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Valandra, to transfer cash in the amount of $7,870.50 from the 100-General Fund to the 226-Emergency Management Fund.

Barry Bailey, acting Sheriff, joined the meeting.

At 11:08 a.m. Tinant made the motion, seconded by Giroux, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

Roll call: All ayes. Motion carried.

At 11:22 a.m. Tinant made the motion, seconded by Valandra, to return to regular session.

Roll call: All ayes. Motion carried.

Giroux made the motion, seconded by Grimshaw, to adopt the following:

RESOLUTION (29-2018):

Be it Resolved by the Todd County Board of Commissioners to hereby Hire Andrew Red Bear as Deputy Sheriff, with 120 days probation under Barry Bailey’s supervision, at $16.50 per hour until probation is complete, and reassess his work performance for the position as Sheriff.

The Board discussed raises for 2019. Tinant made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (30-2018):

Be it Resolved by the Todd County Board of Commissioners to authorize a 3 percent raise for County employees, excluding those on Probation, effective January 1, 2019 as follows:

Hugh Storms, Highway Superintendent, from $47,247.69 to $48,665.00 per year.

The salary of full-time highway construction employees shall be increased as follows:

Tim Murray from $14.71 to $15.15 per hour.

Leroy Swanson from $15.83 to $16.30 per hour.

Torey Huber from $15.71 to $16.18 per hour. 

Owen Marshall from $14.71 to $15.15 per hour.

Jennifer Roubideaux from $14.71 to $15.15 per hour.

Thomas Gunhammer from $14.71 to $15.15 per hour.

Francis Cheauma from $14.71 to $15.15 per hour.

Brad Hunger from $12.79 to $15.15 per hour.

Sonja Lurz, Highway Secretary, from $17.41 to $17.93 per hour.

Walter Lurz, Part- time Custodian, from $127.53 to $131.36 bi-weekly.

Barry Bailey, Active Sheriff, from $17.51 to $18.04 per hour.

Jolene Hagen, Part-time Election worker, from $16.48 to $16.97 per hour.

Kara Walkling, Emergency Management Director, from $644.23 to $663.56 bi-weekly.

The salaries of the Auditor, Treasurer, Register of Deeds and Director of Equalization from $18,000.00 to $18,540.00 per year.

The salaries of the Deputies in the Auditor, Treasurer, Register of Deeds and Director of Equalization offices, from $500.00 to $515.00 per month.

Ron Valandra, Veterans Service Officer, came into the meeting to discuss his wages. Mr. Valandra would like a $3.00 an hour increase. Discussion was held by the Commissioners. Heinert made the motion, seconded by Giroux, to increase Ron Valandra from $12.73 to $15.73 per hour.

Roll call: Ayes: Grimshaw, Giroux and Heinert. Nays: Tinant. Abstain: Valandra. Motion carried.

At 11:42 a.m. Giroux left the meeting.

The Register of Deed’s Statement of Fees Collected during the Month of November, 2018 showed $835.00.

Tinant made the motion, seconded by Valandra, that the claims be approved as follows:

A 11:57 a.m. Valandra made the motion to adjourn until January 2, 2019 at 10:00 a.m., seconded by Tinant.
