The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on December 5, 2018 at 10:12 a.m. Roll call showed Board members Gregg Grimshaw, Patsy Valandra and William Giroux. Absent was Marshal Tinant and Alec Whipple. Also present was Auditor Barbara DeSersa.

Lynda Douville, RST-Map-21 Program Director, came to the meeting to discuss the Right of Ways for the BIA Route 7- Rosebud to US Highway 83 Improvement Project. The Rosebud Sioux Tribe will now pay for the right-of-way for county roads within the project limits.

At 10:17 a.m. Marshal Tinant, Commissioner, entered the meeting.

Ms. Douville said the above-mentioned Project will start in April or early May of 2019 and asked that the Chairman have permission to sign the Right of Ways when she receives them. Tinant made the motion, seconded by Giroux, to give the Chairman permission to sign the Right of Ways for the RST- Map-21 Project.

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Valandra, to accept Alec Whipple’s resignation as District IV Commissioner.

Roll call: All ayes. Motion carried.

Tinant made the motion, seconded by Giroux, that the minutes of the meeting held on November 21, 2018 be approved as read.

Roll call: All ayes. Motion carried.

Llewellyn Wright came to the meeting to complain about the tube that was put in his approach to his driveway. Mr. Wright would like a culvert instead of the tube and will take the County to court if he must install it himself. Mr. Wright said that the ditch was taken out and now people are unable to get to the cemetery unless he is home and would like that fixed back to the way it was. Mr. Grimshaw said they will have Hugh Storms, Highway Superintendent, look into it.

Mike Blom, Mellette County Sheriff, came to the meeting to ask the Commissioners if they would like to enter into a yearly Contract for Sheriff Services. Mr. Blom would hire a Deputy Sheriff to live in Todd County and the County would in return pay Mellette County for their services and furnish the vehicle. Mr. Blom asked the Commissioners to consider the offer to contract out their sheriff office. The Commissioners indicated that they would consider this option along with others currently available as well as any new applicants who apply during the advertising period.

Barry Bailey, acting Sheriff, came to the meeting to recommend Andrew Red Bear for the Sheriff’s position. Mr. Bailey said he would be willing to work with Mr. Red Bear during a probationary period.

At 10:42 a.m. Valandra made the motion, seconded by Giroux to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

Roll call: Ayes: Grimshaw, Valandra and Giroux. Nays: Tinant. Motion carried.

At 10:51 a.m. Tinant made the motion, seconded by Valandra, to return to regular session.

Roll call: All ayes. Motion carried.

Andrew Red Bear entered the meeting. The Commissioners explained to Mr. Red Bear and Mr. Bailey that they would like to keep them hired as is for now and advertise the position for 2 weeks.

Tinant made the motion, seconded by Giroux, to give the Auditor permission to advertise the Todd County Sheriff position.

Hugh Storms, Highway Superintendent, came to the meeting to give his report.

At 10:55 a.m. Tinant made the motion, seconded by Valandra, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

At 11:10 a.m. Tinant made the motion, seconded by Valandra, to return to regular session.

Roll call: All ayes. Motion carried.

Discussion was held on Mr. Wright’s approach. The crews have been moving snow.

An application for the abatement of taxes was presented for Parcel 03B.41.03.4200. The property is a Mobile Home belonging to Cliff D Bryan. The MH was moved to Mellette County in 2016.

Tinant made the motion, seconded by Giroux, to approve the application as presented.

Golden West Tele-communications would like the Highway Superintendent to sign Applications for Occupancy on the right of way of County Highways. Giroux made the motion, seconded by Valandra, to give the Highway Superintendent permission to sign the applications.

The Auditor’s Account with the Treasurer was presented for the approval of the Board as follows:

Tinant made the motion, seconded by Valandra, to amend the levy for the 2019 Annual Budget from 3.635 to 3.623 per $1,000.00.

Tinant made the motion, seconded by Valandra, to authorize the Auditor to post a Notice of Hearing on December 28, 2018, to consider supplements to various County budgets for 2018.

Roll call: All ayes. Motion carried.

The Todd County Commission will hold a hearing at 11:00 AM on December 28, 2018, in the Commissioner Meeting Room, to consider supplementing the 2018 Annual Budget as follows:
