Of Finding Of No Significant Effect And Request For Release Of Funds

To All Interested Agencies, Groups and Persons:

On or about March 9, 2016. The Rosebud Sioux Tribe will request the U.S. Department of Housing and Urban Development to release Federal funds under Title I of the Housing and Community development Act of 974 (PL 93-303 for the following project: Home site Description for acquisition and/or rehabilitation of 2-4 plex apartments consisting a total of 8 units.

SWA is interested in acquiring the property in Mellette County, South Dakota with the legal description of the following:

Record# 3928 Original Town, Block 3 of Lot 4

An Environmental review for the projects been made by the Council is available for public examination and copying at the office noted above. Based on the review the Council has determined that a request for release of project funds will not significantly affect the quality of the human environment and hence, and environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (PL 91-910), All interested agencies, groups or persons disagreeing with these decisions are invited to submit written comments for consideration by the Council prior to the above date. All comments must clearly specify which decision they object to the Finding of No Significant Effect or the Request for release of Funds. All Comments to be received will be considered by the Council prior to its taking any administration actions or requesting releases of funds on the date listed immediately above.

The Council will undertake the project described above with Block Grant funds from the U.S. Department of Housing and Urban Development (HUD), under Title I of the Housing and Community Development Act of 1974. The Council is certifying to HUD that the Rosebud Sioux Tribe and Mr. William “Willie” Kindle, Rosebud Sioux Tribal President at the time of publication, in his Official Capacity consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Council may sue the block grant funds, and HUD will have satisfied its responsibilities under the National Environmental responsibilities listed in 24 CFR part 58. HUD will accept any objection in its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) that the certification was not in fact executed by the Chief Executive Officer or other officer of the applicant’s (b) that applicant environmental review records for the project indicated omission of a required decision finding, or step applicable to the project in the environmental review (c) another Federal agency has submitted written comments pursuant to section 309 or the Clear Air Act of Section 102 (c) of NEPA.

Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and maybe addressed to U.S. Department of HUD, Northern Plains Office of Native American Programs (NPONAP), 1670 Broadway, 22nd Floor, Denver, Colorado 80202. HUD will not consider objections to the release of funds on bases other than these stated above. HUD will consider no objection received after 15 days from the date of request for funds listed above.
