The Todd County School District #66-1 (hereinafter, “the School District”) will receive bids for construction of the Okreek School Addition

Scope Of Work

Complete construction of a school addition with utilities, parking area and sidewalks.

Bids will be received on a lump sum basis.

Pre-Bid Conference: 10:30 a.m. April 20, 2018 at Okreek School Gymnasium in Okreek, SD.

Bidding: Bids will be accepted until 11:00 am , on April 27, 2018, at the Todd County School District Administration Office in Mission South Dakota, after which time they will be opened, read aloud, and accepted for consideration. Bids received after this time will not be accepted.

Indian Preference: It has been determined that this project is subject to Section 7(b) of the Indian Self-Determination and Education Assistance Act and HUD requirements set forth at 25 U.S.C. 450e(b)(1995).

1. Bids are invited from non-Indian as well as qualified Indian-owned economic enterprises or organizations.

2. Indian enterprises or Indian organizations must pre-qualify by submitting evidence of Indian ownership and control to the Tribal TECRO Office by April 24, 2018. Applications are available at the Tribal TECRO Office.

• The Tribal TECRO Office shall review the applications to determine those firms that qualify for Indian Preference.

• Subcontractors must also pre-qualify for Indian Preference.

Bid Security: A Certified Check, Cashier’s Check or Bank Draft drawn on a South Dakota bank, in the amount of five percent (5 percent) of the bid payable to the Todd County School District #66-1 or a Bid Bond in the amount of five percent (5 percent) of the bid issued by a surety company listed in the current U.S. Treasury Circular 570 Surety Companies Acceptable on Federal Bonds.

Requirements Of The Contract: Payment and Performance Security, Davis-Bacon Wage and provisions within the Contract Documents.

Award: The Contract will be awarded to the lowest responsive bid received from a prequalified Indian enterprise if such bid is within budgetary limits and is within “X” percent of the lowest responsive bid from any qualified bidder. “X” is defined in the “Special Instructions to Bidders”. If no responsive bid by a qualified Indian enterprise is within the above stated limits, then award will be made to the bidder with the lowest responsive bid within the budget.

Copies Of The Documents: Documents (11 x 17) may be obtained by Paying $50.00 to Aaron Swan and Associates, 301 West Capitol, Pierre, South Dakota 57501, for each set of documents. Checks shall be made payable to: Aaron Swan and Associates. Partial sets may be purchased at the rate of $1.00 per drawing page and $.15 per specification page. This reproduction cost is non-refundable and the purchaser is responsible for determining which pages are to be reproduced with a written request. Addendum will not be sent to partial set holders. PDF copies of plans and specs will be available at no cost. PDF must be acquired from AS&A to be placed on the plan holders list.

Indian Preference In Subcontracting, Employment And Training: The successful bidder must provide preference in its award of subcontracts, and in its employment and training. All bidders must submit with their bid a statement describing how they will provide Indian preference. Specific details are set forth in the “Special Instruction to Bidders”.

TECRO: The successful bidder must comply with the Tribe’s TECRO Ordinance, including any licensing requirements.

Right To Reject Any And All Bids: This Advertisement for Bids does not commit the School District to award a Contract nor to pay any costs incurred in the preparation of bid(s) or to procure supplies. The School District reserves the right to reject any and all bids, to waive any informalities or irregularities and to re-advertise when it is in the best interest of the School District.
