January 3, 2018

The meeting of the Todd County Commissioners was called to order by the Chairman in the Commissioner Room at the County Building at Mission on January 3, 2018 at 10:05 a.m. Roll call showed Board members Gregg Grimshaw, William Giroux, Patsy Valandra, Alec Whipple and Marshal Tinant. Also present was Auditor Barbara DeSersa.

Whipple made the motion, seconded by Tinant, to approve the minutes from December 29, 2017.

Roll call: All ayes. Motion carried.

Nominations were opened for Chairman for 2018. Tinant nominated Gregg Grimshaw for Chairman. Tinant made the motion, seconded by Whipple, that nominations cease and a unanimous ballot be cast for Grimshaw for Chairman.

Roll call: All ayes. Motion carried.

Nominations were opened for Vice-Chairman. Tinant nominated Alec Whipple for Vice-Chairman. Tinant made the motion, seconded by Grimshaw, that nominations cease and a unanimous ballot be cast for Whipple as Vice-Chairman.

Roll call: All ayes. Motion carried.

Whipple made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (1-2018):

Be It Resolved by the Todd County Board of Commissioners that each member of the Board of Commissioners shall be compensated at the rate of $400.00 per regular meeting attended, and

Further Be It Resolved that each Board member shall be compensated at the rate of $100.00 per special meeting attended, and Be It Resolved Further each Commissioner shall receive mileage at state rate for each mile traveled to attend Board meetings.

Valandra made the motion, seconded by Giroux, to appoint Loren Buettner and Rebecca Rahn to the Fairboard as their terms had expired.

Tinant made the motion, seconded by Valandra, to appoint the Weed and Pest Board members as follows:

Valandra made the motion, seconded by Whipple, to adopt the following:

RESOLUTION (2-2018):

Be It Resolved by the Todd County Board of Commissioners that the Superintendents, Deputies and Interpreters of each election shall be paid a fee of $200.00 pursuant to SDCL 12-15-11 and

Further Be it Resolved, the person delivering the supplies and ballot boxes to the Sheriff’s office or Auditor’s Office shall receive state rates per each mile necessarily traveled in going to and returning from making the delivery, and

Be It Resolved Further that all Superintendents, Deputies and Interpreters shall be allowed a fee of $50.00 for attending an election school at a time and place fixed by the County Auditor.

Whipple made the motion, seconded by Tinant, to adopt the following: 

RESOLUTION (3-2018):

Be It Resolved by the Todd County Board of Commissioners to hereby appoint Monica Rahn as Coroner for Todd County, and 

Further Be It Resolved Ms. Rahn shall be compensated at the rate of $100.00 per call and receive mileage at state rate for miles traveled to fulfill her duties.

Valandra made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (4-2018):

Be It Resolved by the Todd County Board of Commissioners to hereby compensate members of the Fairboard $25.00 per meeting attended, and

Further Be It Resolved that each member of said Board shall be compensated for miles driven to fulfill that duty at the state rate for mileage.

Tinant made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (5-2018):

Be It Resolved by the Todd County Board of Commissioners to hereby designate the Todd County Tribune as the official newspaper for Todd County for 2018.

Tinant made the motion, seconded by Valandra, to adopt the following:

RESOLUTION (6-2018):

Be It Resolved by the Todd County Board of Commissioners to hereby designate Wells Fargo Bank in Mission and First Fidelity Bank and Bank West, both located in Winner, South Dakota, as official depositories of county funds.

Tinant made the motion, seconded by Valandra, to adopt the following:

RESOLUTION (7-2018):

Be It Resolved by the Todd County Board of Commissioners that the Board of Commissioners shall meet for the transaction of official business on the first and third Wednesday of each month unless rescheduled, with the exception of September, when the first meeting of the month shall be held on the first Tuesday for consideration of the provisional budget pursuant to SDCL 7-21-8.

The Board discussed raises for 2018. Whipple made the motion, seconded by Giroux to adopt the following:

RESOLUTION (8-2018):

Be it Resolved by the Todd County Board of Commissioners to authorize a 3 percent raise for all County employees effective January 1, 2018 as follows:

Hugh Storms, Highway Superintendent, from $45,871.59 to $47,247.69 per year.

The salary of full-time highway construction employees shall be increased as follows:

Randy Vrbka from $14.28 to $14.71 per hour.

Tim Murray from $14.28 to $14.71 per hour.

Leroy Swanson from $15.37 to $15.83 per hour.

Anthony Night Pipe from $14.28 to $14.71 per hour.

Torey Huber from $14.28 to $14.71 per hour.

Stanley Heinert from $14.28 to $14.71 per hour. 

Owen Marshall from $14.28 to $14.71 per hour.

Calvin Hunger from $14.28 to $14.71 per hour.

Jennifer Roubideaux from $14.28 to $14.71 per hour.

Sonja Lurz, Highway Secretary, from $16.90 to $17.41 per hour.

Walter Lurz, Part- time Custodian, from $123.82 to $127.53 bi-weekly.

James Burnette, Part- time Custodian, from $123.82 to $127.53 bi-weekly.

Carl Hunger, Sheriff, from $45,000.00 to $46,350.00 per year.

Barry Bailey, Deputy Sheriff, from $17.00 to $17.51 per hour.

Ronald Valandra, VA Service Officer, from $12.36 to $12.73 per hour.

Jolene Hagen, Part-time Election worker, from $16.00 to $16.48 per hour.

Kara Walkling, Emergency Management Director, from $527.98 to $543.81 bi-weekly.

The monthly salaries of the Auditor, Treasurer, Register of Deeds and Director of Equalization from $13,706.16 to $18,000.00 per year, from new contract.

The monthly salaries of the Deputies in the Auditor, Treasurer, Register of Deeds and Director of Equalization offices, from $198.87 to $500.00 per month, from new contract.

Discussion was held on what the protocol should be in adverse weather conditions. Tinant made the motion, seconded by Giroux, to adopt the following:

RESOLUTION (9-2018):

Be it Resolved by the Todd County Board of Commissioners to hereby amend the newly revised Todd County Personnel Handbook under 4.1.1: ADVERSE WEATHER CONDITIONS to read:

A. According to SDCL 7-7-2.1, the chairman of the board of county commissioners will make the determination, that (he/she) may close the county building in case of emergency or severe weather and each such closing shall be for no more than one business day. An emergency for the purpose of this section is an unforeseen occurrence or combinations of circumstances which calls for immediate action or remedy. In the event of such closing, office employees will be compensated for hours of work missed at their regular rate of pay. Highway employees will be compensated at 1.5 times their regular rate of pay.

Kara Walkling, Emergency Manager, joined the meeting. She informed the Commissioner that she and Bill Giroux have been working on a Civil Disturbance Plan, that must be done because of the TransCanada Pipeline that will be going through neighboring Counties. Mrs. Walkling mentioned the Pre-Disaster Litigation Plan has been approved and the next LEPC meeting will be on January 17, 2018 after the Commissioners meeting. Mrs. Walking also said her phone is not working correctly. The Commissioners approved the purchase of a new phone and accessories.

William Giroux left the meeting.

Ron Valandra, VA, Carl Hunger, Sheriff and Hugh Storms, Highway Superintendent, entered the meeting. The Commissioners informed them of the raises and the weather closing resolution that they implemented. Mr. Hunger would like to see the Sheriff clothing allowance increased, it is now set at $300.00 a year. The Commissioners asked him to get some clothing prices and this would give them a guideline as to how much it should increase. Mr. Hunger and Mr. Valandra left the meeting.

At 11:00 a.m. the 2017 fuel bids were opened as advertised. 

Bids were received as follows:

Unleaded Gasoline Clear (87 octane), $2.45

#2 Diesel Dyed, $2.38

Tinant made the motion, seconded by Whipple, to accept the bids submitted by Country Pride Coop.

At 11:02 a.m. Tinant made the motion, seconded by Valandra, to enter into Executive session to discuss a personnel issue pursuant to SDCL 1-25-2 (1).

At 11:08 a.m. Whipple made the motion, seconded by Valandra, to return to regular session.

The Auditor’s Account with the Treasurer was presented for the approval of the Board as follows:
