Purpose: The purpose of this notice is to state the EPA’s intention to issue a National Pollutant Discharge Elimination System (NPDES) permit under the authority of Section 402 of the Clean Water Act. 

Activity: The WWTP treats the sanitary wastes from the Rosebud Casino/Annex, hotel, and adjacent fuel plaza. All treated wastewater from the WWTP discharges to the Rock Creek. The discharge outfall is located at latitude 43.000556 N, longitude 100.576389 W. Authorization for discharge is limited to only the outfall specifically listed in the Permit.

Public Comments: Comment period ends 30 calendar days after the date of publication of this notice. Comments must be directed to: Qian Zhang (8WP-CWW), U.S. Environmental Protection Agency, Region 8, 1595 Wynkoop Street, Denver, CO 80202-1129. All comments received prior to the end of the comment period will be considered in the formulation of any final permit determination, and will be part of the administrative record. Any commenter may request a public hearing and the EPA will hold a hearing if the response to this notice indicates significant public interest. The EPA is also requesting comments on the possible adverse effects of reissuing the permit on historic properties and/or cultural resources in the area.
